DMCA Policy
Last Updated: July 27, 2024
Muqewia respects the intellectual property rights of others and expects users of its platform to do the same. This Digital Millennium Copyright Act Policy ("DMCA Policy") describes how Muqewia responds to claims of copyright infringement and how rights holders may submit a valid takedown notice.
1. Reporting Copyright Infringement
If you believe that content available on or through our platform infringes one or more of your copyrights, you may submit a written notification to our designated copyright agent. Your notification must include all of the elements described below to be considered valid under the DMCA.
1.1 Required Elements of a Valid Notice
To be effective, your written notice of claimed infringement must include the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on our platform.
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notification Procedure
If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated copyright agent. A valid counter-notification must include the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of a competent court and that you will accept service of process from the person who provided the original notification or an agent of such person.
Upon receipt of a valid counter-notification, we may restore the removed material within ten to fourteen business days, unless the original complaining party files a court action seeking to restrain you from engaging in infringing activity relating to the material.
4. Repeat Infringer Policy
Muqewia maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A user may be considered a repeat infringer if they have been the subject of multiple valid DMCA takedown notices. We reserve the right to make this determination at our sole discretion based on the circumstances of each case.
5. False Notifications
Please be aware that submitting a false or misleading DMCA notice may expose you to legal liability. Under applicable law, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to damages, including costs and legal fees incurred by the alleged infringer, the platform, or its licensees.
We strongly encourage you to seek legal counsel before submitting a DMCA notice if you are unsure whether the content in question actually constitutes infringement.
6. Modifications to This Policy
Muqewia reserves the right to modify this DMCA Policy at any time. Changes will be reflected by updating the "Last Updated" date at the top of this page. Continued use of our platform following any such changes constitutes your acceptance of the revised policy.
